The transfer of Mustapha Carayol from Torquay United to the Imps has taken an unusual turn with City declaring they think they have found a loophole that would deny Torquay any compensation for the 20 year old.

Normally, if a player is under the age of 24 then the club that player is leaving would be entitled to compensation. This would be to cover the costs of developing the youngster, however, City believe that they might have found a loophole in this ruling.

Carayol may be under the age of 24, but he was neither in the youth set-up at Torquay, nor did they pay a fee for him when he joined from MK Dons. In other words, the player was not a youth team player when Torquay picked him up, and therefore had very little say, if any, in his development as a youth player.

Dave Roberts has stated he believes this to be a loophole in today's Echo.

"We feel that there is no case for a fee as the player is out of contract, that is our position and we have made that quite clear to Torquay. The onus is on Torquay now. We have agreed terms with the player and that is a done deal."

It means that there is yet another twist in this transfer story as Torquay said last week that they would not be releasing Carayol's registration until they receive an offer they consider reasonable. It is an unusual situation that the clubs and player find themselves in and this latest statement could easily just be mind-games to try and get Torquay to agree to a lower fee, or it could be that the Imps genuinely believe they have a case for not paying any compensation at all.

Due to this latest development, it seems almost inevitable that the transfer will go to tribunial.

My own suggestion would be to do a Deal or No Deal situation, it'd be quicker than what is happening at the moment.

Surely this is the same siuation as we found ourselves in with N'Guessan. We received compensation from Leicester didn't we?

It is bad enough losing players for free on a "Bosman"

It would be worse if we lost our under 24 players for free on a "Lincoln"

I think we paid an undisclosed fee for N'Guessan, hence why we got a fee from Leicester.

The club is just putting forward a case it will make to a tribunial. It's exactly why tribunials exist.

Kovacs didn't go through Chesterfield's youth system, and I don't think they paid a fee for him, yet we still had to pay £17,500 compensation. I will be very surprised if we get him for nothing.

Bit diffrent bringing him over from Hungary though.

I think we'll pay a fee, and I imgine everyone at the Club expects us to do so. I suspect the fee will be closer to our apparennt valuation of £0 than theirs.

My interpretation, as opposed to media spin, is that we are not seeking to avoid paying for an under 24 year old, or find a loophole in the Bosman ruling.

We have offered, as a transfer fee, a share of any sell-on clause, we may get for Carayol, while he is under contract with us.

This will be our starting position at any tribunal and Torquay will have to argue for whatever they think they should receive.

Our arguement is that Torquay paid nothing for him; he was already developed, so they put nothing into his development and he would have been offered X which he rejected as not being enough and is probably less than average for a League 2 player.

With DNG we took him at a younger age; agreed a sell-on clause with Rangers; and offered him the highest wage we had offered any player in our history, before his contract was due. He also featured in a number of League 2 teams of the week and I think he was nominated for a League 2 Player of the Year Award.

We played the sytsem with DNG and that is what we are doing with Carayol, but from the other side of the fence.

Having said that, I have been wrong before, and I will be again.
